As most of my readers know, I am a bicycle accident lawyer and have been representing bicycle accident victims for over 20 years. In addition, I am an avid cyclist myself. Accordingly, I have a tremendous amount of expertise representing bikers. Cyclists come in many forms: commuter, road cyclist, track, bmx, mountain, etc. However, there are some traits that most bikers share. Most bikers are used to dealing with pain and at some level even enjoy it (when training). Part of being a cyclist is tolerating some pain and aches. We all know that when the group surges, you have to push your body sometimes to not get dropped. When you are fighting a cold, you deal with it and still ride. When it is cold outside, you put your gear on and get your ride in. Most bikers want to be on their bikes enough to put up with some pain and discomfort.
For me and I suspect most, the bike is more than just a tool to keep your body in shape but your mind as well. As a whole, bikers are doers. Therefore, cyclists rarely will let injuries or illnesses keep them off the bike. As I like to say it is “mind over matter, if you don’t mind it don’t matter”. Well all these traits are commendable UNLESS you are a bicycle accident victim client. Here is why. Anything you do after an accident that makes it appear your injury was not serious hurts your case. Therefore, when you get back on your bike too soon (and almost every biker does), it appears that your injury has healed more than it has. When you speak to your doctors, don’t downplay your injuries. I am not saying to exaggerate, but don’t go the other way and minimize!

Many bikers refuse a visit to the Emergency Room or suffer too long before finally seeking medical attention. This also hurts your case. Since the insurance company will use this delay in getting treatment as a sign that you injured yourself in a separate incident, not related to the accident. Well, hopefully, you never become a bicycle accident client, but if you do, please keep this advice in mind.
Ride. Be Safe. Have fun.
