Rarely will an insurance company even let you know what I’m about to talk about, and that’s what I call loss of use. What is loss of use? Loss of use is your right to recover money for what it would cost to replace the use of your vehicle while it’s being repaired. That means that you don’t have the ability to use that vehicle, and therefore, of course, you have a loss of use claim.
So it doesn’t make a difference whether or not you’ve been able to use your vehicle. If you broke your leg, you can’t really ride your motorcycle, but you still lost the right to use it. You can’t lend it out to a friend. You can’t have it available to somebody else. So what are you entitled to?
You’re entitled to the reasonable amount of money it would cost to rent that vehicle during the time your vehicle is being repaired. You look at the type of vehicle that you have lost use of. If it’s a very expensive automobile, it would be a similar vehicle. If it’s a very expensive motorcycle, it would be similar. You don’t have to accept just a rental. You could take the money if you choose to. It’s not a question of you’re forced to just get a rental car during the time you don’t have use of your vehicle. You could say, you know what? I’d rather just have the money, in almost every state that’s available to you. Rarely will the insurance company even let you know that you could also get money for loss of use if you decide not to rent something.
