Today I want to talk about the term ‘loss of consortium.’ It’s a legal term for the loss of companionship, love, affection, and support that a partner’s injury or death causes their spouse. Loss of consortium would happen when an injured person can’t care for, love, or be intimate with a partner as much as they did before the injury.
For example, if a person is involved in a motorcycle accident that renders him immobile for an extended period of time, his or her spouse may suffer loss of consortium because they can no longer engage in the same physical activities or intimacy that they did prior to the accident. The spouse of the injured party may file a loss of consortium claim as part of a personal injury lawsuit to receive compensation for the psychological and emotional harm that was caused from them. This is a separate claim from the person who is involved in the motorcycle crash.
