Defective bicycle frame.

As cyclists we all are very aware of all the dangers of riding a bicycle.  However, one risk,  most people never think about is a product failure of their bicycle.  A defective  bicycle  is more common than you might think.  It can be anything from the bicycle being improperly assembled to a latent design defect, such as a compromise of the seat  post.  If you are involved an accident and believe the failure of your bicycle caused it, you must do 3 things to have any chance of a recovery.

First, bring the bike to a secure place such as your  home.   Two,  DO NOT TOUCH IT!.  I can not emphasize this point enough.  You can not repair it, or even attempt to disassemble it.  The bike must stay in the original condition post accident.   Three, it is very important to have the bicycle examined by a seasoned bicycle expert.  At our firm, we use one of the top bicycle experts in defective design/assembled bicycle cases.   We recently represented a girl that purchased a bicycle from Walmart.  When she got home with her  new bike, she went for a ride.  Almost immediately, the wheels locked and she was thrown to the ground striking and fracturing her face.  She required surgery inserting plates and screws in her face.  She faced months of pain and suffering.  We hired an expert as did Walmart to look at the bike.   Our expert was able to establish that the bike was assembled  negligently and Walmart  settled for a significant amount of money before trial.    Our firm has handled numerous product defect/design and negligent assembled bike cases.   Again, it is important to secure and never touch the bicycle after an accident until you speak with a qualified bicycle injury lawyer.
