It is Time for Justice for Victims of Bicycle Accidents

There is rarely a criminal prosecution against the driver of a motor vehicle when he/she causes injury or death to a bicyclist. There is a clear and unmitigated bias against all bicycle riders. The message being sent across the country is clear: if you are on a bicycle you are not entitled to the same rights as every other user of the roadways.

When a motor vehicle causes injury to one of its occupants or to another motor vehicle there is almost always a criminal investigation and possibly criminal charges. As a cyclist, you are much more vulnerable to the actions of the motor vehicles you are sharing the road with. In fact, there should be an even higher standard of care for motor vehicle when driving near or passing a bicycle. I recently came across an article that speaks about this very issue.  I thought it perfectly expressed the present attitude toward the prosecution of negligent drivers that cause injury to cyclists.  This was an accident (collision) that occurred about a year ago, June 12, 2013, in Beverly Hills, CA and explains in detail how the district attorney and police failed to take action after a cyclist was nearly killed.

I urge all my readers to take the time to read this story. I think it will make you sick in the stomach as it did for me.  At my law firm, Kass & Moses, we work tirelessly to protect the rights of bicycle accident victims.  However, in order for the laws and attitude to change it is imperative that all bikers and non-bikers get outraged about how little is done to protect bikers and provide justice for those that harm them. If you ever know or hear about a biker injured due to the negligence of a motor vehicle please urge the local police and prosecutor to take action!!!
