The weeks following a motorcycle accident can be filled with anxiety. Your motorcycle is damaged and sitting at a tow yard. You may have been injured and need medical treatment. Insurance companies are calling asking you to give a recorded statement and/or cooperate with them. So you call an experienced motorcycle accident lawyer to represent you. What happens then?

Opening your case

To begin with, your motorcycle accident lawyer will have you sign an attorney-client contract and several “releases” that will enable your lawyer to obtain the police report, your medical records and lost wages information.

Identify Defendants

Often our clients don’t know who hit them because they were taken away by ambulance before they could obtain the other party’s information. We will find these parties for you. In addition, it is possible that the person who hit you was in the “course and scope” of his/her employment, or the vehicle was owned by another party or business, and as such, there may be another potential defendant such as his/her employer.  If you were injured by a defective product the defendant might be the maker of your motorcycle. Lastly, you may have been injured by a pothole or by gravel left on the ground by an unknown company. It is not always clear in these cases who the actual defendant is.  We will find them.

Contact the insurance companies

For a free legal consultation,
call 1-800-414-5196

We will immediately fax a letter to your insurance company and to the insurance company for the person who hit you, notifying them that you are now represented by counsel and that all communication should be directed to our office.  We will convince the third-party insurance company (insurance for the person who hit you) to accept liability/responsibility for the accident. Once insurance accepts liability, we will work to get you compensated for your damages.

Investigation

Our office will contact any witnesses to the accident, obtain photographs of the scene of the accident and of your injuries and will arrange to obtain information verifying your lost wages.

Property Damage

We will ensure that your motorcycle is inspected. The appraiser will either determine that the bike is repairable or is a total loss. We will also work to get you reimbursed for personal property that was damaged in the accident which could include your jacket, gloves or boots, or other items such as your phone.

Conclusion

After this initial stage of your case, we will coordinate with you to ensure you are receiving appropriate medical care.  We will then order your medical bills and records. Once you are through treating we will put together all the information in a demand package that we send to the insurance company on your behalf.
