There are over 114,000 serious motorcycle crashes in the United States each year, and each of these incidents will involve negotiations with an insurance company and a settlement of some type. But before you enter into talks with an insurance adjuster, we recommend that you speak with an experienced motorcycle injury attorney.
Insurance Adjusters Want You to Settle for Less
Insurance adjusters are trained to get you to settle for less money than you deserve. They have a number of tricks up their sleeves that they may use against you, including:
- Early contact – The insurance company will likely contact you shortly after your accident. During this initial phone call, they will ask you questions and may even offer a settlement. If you have been injured, it might seem easier to simply accept their offer and get the money quickly. Remember, however, that these offers are lowball attempts to get you to settle for less than you deserve. In some cases, the offer may not even be enough to cover your medical bills, not to mention any pain and suffering or lost wages.
- Plenty of questions – The insurance adjuster will likely have lots of questions to ask you. Although it may seem that they are simply trying to understand what occurred, remember that they can use your words against you. Never allow a taped conversation to occur without discussing it first with an attorney. Remember, you do not have to answer their questions. Your answers may be spun to make your injuries appear less significant. For example, the adjuster may ask how you are feeling, and out of habit you may answer, “fine.” They can use this information later and state that you said you felt fine and therefore couldn’t be injured.
- Attempting to build a rapport – The insurance adjuster is not your friend, though they may seem to be concerned about your wellbeing. Often they may suggest that they are on your side, and that they simply want to help you get the money you deserve. Remember- they are not on your side. They have been trained to use tactics to get you to settle for as little money as possible.
- Questioning your injuries and motives – If all else fails, the insurance adjuster may try to question your degree of injuries or your motives. Do not be surprised if they claim you are attempting to get money you do not deserve or that you are being deceptive about your injuries.
