The California motorcycle accident lawyers at Kass & Moses recently obtained compensation for a client injured in a T-bone accident in Stockton, California. Our client was driving his motorcycle when a Chevrolet Silverado pick-up truck attempted to make a left turn in front of him thereby causing a collision. Our client was thrown from his motorcycle, slid on the ground and flipped over several times before coming to a stop. He suffered a micro fracture to his L1 vertebrae and severe bruising to his testicles and thigh as well as significant road rash to his arms and legs.

The insurance company tried to place 50% responsibility for the accident on our client for speeding. To support their contention, the insurance company referred to the police officer’s report which stated that our client must have been speeding because there were allegedly 193 feet of skid marks from our client’s motorcycle.

Our California motorcycle accident lawyers rejected the insurance company’s argument entirely. We pointed out that our client could not have skidded 193 feet (or 65 yards) without falling. Also, during our investigation we spoke to and obtained a signed affidavit from a witness to the accident who verified that he did not believe that our client was speeding prior to the accident.

One item of note is that our client did not have private insurance but instead was insured through Medi-Cal. As such, our office had to negotiate with the California Department of Health Care Services to pay our client’s medical bills.
